The terms that apply when you buy a ticket through Locanter

These Ticket Purchase Terms (the Ticket Purchase Terms) apply when you buy a ticket for an event through the Locanter platform. Please read them carefully. By completing a purchase, you agree to them.
In short (this summary is for convenience only and does not form part of these Ticket Purchase Terms):
When you buy a ticket, you are buying from the organiser, who is the seller. Locanter runs the checkout and collects payment on the organiser’s behalf, and charges you a service fee for using the platform. Refunds of the ticket price are the organiser’s responsibility under their refund policy. You generally cannot cancel a ticket for a dated event because you changed your mind, but if the event is cancelled or materially changed, you are entitled to a refund.
1.1 These Ticket Purchase Terms apply when you buy a Ticket for a Natively-Ticketed Event through the platform. They are between you and the relevant Host, and, for the Service Fee and your use of the platform, between you and Locanter.
1.2 These Ticket Purchase Terms add to our Platform Terms of Use (the Platform Terms), which govern your use of the platform generally and which are incorporated into these Ticket Purchase Terms by reference. Our Privacy Policy, available at https://locanter.com/privacy, also applies.
1.3 The Host’s own terms for the Event (the Event Terms) and the Host’s refund and cancellation policy (the Refund Policy) also apply to your Ticket and your attendance at the Event. They form part of your contract with the Host and are shown on the Event listing or at checkout.
1.4 If there is any conflict: for the purchase of a Ticket, these Ticket Purchase Terms prevail over the Platform Terms; for your use of the platform generally, the Platform Terms apply; and for your personal data, the Privacy Policy applies. The Event Terms govern the Event and your attendance. If a Host’s Event Terms conflict with these Ticket Purchase Terms specifically about the sale or refund of a Ticket, these Ticket Purchase Terms prevail to the extent of that conflict.
1.5 Words with capital letters that are not defined in these Ticket Purchase Terms have the meaning given to them in the Platform Terms.
In addition to the defined terms in the Platform Terms, the following words have the following meanings:
“Booking Confirmation” means the confirmation we provide to you, on behalf of the Host, once your purchase is complete.
“Event Terms” means a Host’s own terms and conditions for an Event.
“Order” means your request to buy one or more Tickets for an Event through the platform.
“Refund Policy” means a Host’s refund and cancellation policy for an Event.
“Ticket Price” means the price of a Ticket set by the Host, which is payable to the Host.
“Total Price” means the total amount payable by you for an Order, made up of the Ticket Price for each Ticket plus the Service Fee, and including any applicable taxes.
3.1 When you buy a Ticket for a Natively-Ticketed Event, you buy it from the Host. The Host is the seller of the Ticket and the merchant of record.
3.2 Locanter acts only as the Host’s limited agent: we operate the checkout through which the Host sells the Ticket, we conclude the sale on the Host’s behalf, and we collect the Ticket Price on the Host’s behalf. We are not the seller, we do not own or take title to any Ticket, and we are not a party to the contract of sale between you and the Host.
3.3 Separately, Locanter provides the platform to you and charges you the Service Fee for facilitating your booking, under the Platform Terms. The Service Fee is the only amount you pay to Locanter for its own account.
3.4 The Host is responsible for the Event and for meeting its obligations to you as the seller of the Ticket, including providing the Event, admission, and any refund due. Your rights in respect of the Ticket and the Event are against the Host. Clause 9 explains how refunds and cancellations work.
3.5 We show you the identity of the Host on the Event listing and at checkout. Some Hosts are businesses (traders) and some are individuals, community groups or public bodies. Where a Host is not acting as a trader, some consumer protections may not apply to your contract with that Host.
4.1 To buy a Ticket you must have an account that meets the eligibility requirements in the Platform Terms.
4.2 You must be at least 16 years old to buy a Ticket. If you are aged 16 or 17, you may only buy a Ticket with the consent and involvement of a parent or guardian who agrees to be responsible for the purchase.
4.3 Some Events have age restrictions, identification requirements or other entry conditions set by the Host. You are responsible for checking and meeting these before you buy. If you do not meet them, the Host may refuse you entry, and you may not be entitled to a refund.
5.1 To place an Order, you select the Event, the ticket type and the number of Tickets, provide the information requested, and pay the Total Price.
5.2 Please check your Order carefully before you pay, including the Event, date, time, location, ticket type, quantity and price, because Tickets are generally not refundable if you change your mind (see clause 9).
5.3 The step at which you pay makes clear that you are placing an Order with an obligation to pay.
5.4 Your contract for the Ticket with the Host is formed when we, acting as the Host’s agent, accept your Order, payment of the Total Price is taken, and we issue your Booking Confirmation. Until then there is no contract, and the Order may be declined.
5.5 We may decline or cancel an Order, on the Host’s behalf or under the Platform Terms, for reasons including that the Event has sold out, suspected fraud or unauthorised payment, a pricing or listing error, or a breach of the Platform Terms. If we cancel an Order after payment for a reason that is not your fault, you will receive a full refund of the Total Price for that Order.
5.6 Pricing errors. If the Ticket Price for an Event is obviously incorrect, the Host is not required to sell the Ticket at that price. We will contact you so that you can choose to continue at the correct price or receive a full refund.
6.1 The Total Price is made up of the Ticket Price, which is set by and payable to the Host, plus the Service Fee charged by Locanter under clause 8 of the Platform Terms. The breakdown is shown to you clearly before you pay.
6.2 All prices shown to you include any applicable taxes. Where the Host is required to account for VAT on the Ticket Price, it is included in the Ticket Price shown. Locanter is not currently registered for VAT and does not charge VAT on the Service Fee; if this changes, any VAT on the Service Fee will be included in the Service Fee shown to you.
6.3 Payments are collected and processed by our payment processor, Stripe. By paying, you authorise us and our payment processor to charge your chosen payment method for the Total Price.
6.4 The Ticket Price is collected on the Host’s behalf and paid to the Host. Locanter does not receive the Ticket Price for its own account.
6.5 We are not responsible for any charges your bank or card provider applies, such as foreign transaction fees.
6.6 After your purchase is complete, we will provide a Booking Confirmation and a receipt, which you can access in the app and which we may also send to you by email.
7.1 Once your contract is formed and payment is taken, your Ticket is made available to you in the app and, where applicable, by email, normally as a QR code.
7.2 Your Ticket is evidence of the right of admission to the Event granted to you by the Host.
7.3 Keep your Ticket secure. Do not share, copy, screenshot for distribution, or otherwise reproduce it. Each Ticket admits the stated number of people once. Entry is normally granted on the first valid scan, and a Ticket that has already been scanned, or that appears to be duplicated or altered, may be refused.
7.4 Treat your Ticket like cash. To the extent that we and the Host are not at fault, neither we nor the Host is responsible if a Ticket is lost, stolen, or copied and used by someone else before you.
7.5 You must not forge, alter or duplicate Tickets or QR codes. Doing so is prohibited, may invalidate the Ticket, and may be treated as fraud and reported.
7.6 If your payment is taken and confirmed but a Ticket is not issued to you, for example because of a technical problem, contact us using the details in clause 14 and we will arrange for the Ticket to be issued or, if that is not possible, provide a full refund of the Total Price for that Ticket.
8.1 Tickets are sold for personal use. You must not resell a Ticket, transfer it for profit, sell it in the course of a business, or otherwise commercially exploit it, unless the Host expressly permits it and the law allows.
8.2 We may, on the Host’s behalf or under the Platform Terms, cancel or void Tickets that we reasonably believe have been resold or offered for resale in breach of these Ticket Purchase Terms, touted, obtained fraudulently, or obtained or used in breach of the Platform Terms, and the Host may refuse entry. Where a Ticket is voided because of your breach, you may not be entitled to a refund.
9.1 The Host’s Refund Policy governs refunds and cancellations of Tickets, subject to your legal rights that cannot be excluded. The Refund Policy is shown on the Event listing or at checkout, and the Host is responsible for providing refunds of the Ticket Price.
9.2 Nothing in the Refund Policy or these Ticket Purchase Terms affects your statutory rights as a consumer.
9.3 If the Host cancels the Event, or changes its date, time or location, or another aspect of it, in a way that is material to you, you are entitled to a refund of the Ticket Price from the Host, as set out in the Refund Policy and the law. Where you are entitled to a refund of the Ticket Price in these circumstances, Locanter will also refund the Service Fee attributable to the refunded Ticket(s).
9.4 We operate a platform refund process and, in the situations below, we will process refunds to you directly through the platform, regardless of the Host’s Refund Policy: (a) if the Host cancels the Event, you will receive a full refund of the Ticket Price; (b) if there is a material change to the Event (for example a significant change to its date or time, a change of venue, or a change to its age restriction), we will offer you a refund; (c) if the Host does not respond to a refund claim within the timeframe set out in our refund process, we will decide the claim ourselves: where our own records confirm the grounds for the claim (for example, a change to the Event that we notified you about), we will issue the refund automatically; otherwise we will review the claim and the evidence you provided, and issue a refund if we uphold it; and (d) if we determine that the Event did not take place or was effectively cancelled, we may refund affected Tickets. The Ticket Price for these refunds is recovered from the Host, but where these situations apply your refund does not depend on the Host choosing to provide it.
9.5 Refunds are normally made to the payment method used for the Order, and are usually processed within 5 to 10 business days of being approved.
9.6 Other than as set out in clause 9.3, or where the Host’s Refund Policy or the law gives you a right to a refund, Tickets are non-refundable, including if you change your mind or cannot attend. The Service Fee is non-refundable except as set out in clause 9.3 or as required by law.
9.7 If an Event is rescheduled to a new date, your Ticket will normally remain valid for the new date if you wish to keep it. A reschedule is treated as a material change, so if the new date does not suit you, you are entitled to a refund as set out in clause 9.3. If the Event is postponed without a new date, we will offer affected buyers a refund. Any other right to a refund is as set out in the Host’s Refund Policy and the law.
9.8 Right to cancel (cooling-off period). Under the Consumer Rights Act 2022 and the Consumer Rights Directive, the right to cancel a distance contract within 14 days does not apply to contracts for the provision of services related to leisure activities where the contract provides for a specific date or period of performance. A Ticket for an Event taking place on a specific date or during a specific period falls within this exemption. This means you do not have a 14-day right to cancel such a Ticket purchase. This does not affect your rights if the Event is cancelled or materially changed, or any other rights you have that cannot be excluded.
10.1 Admission to the Event is controlled by the Host. The Host sets the entry conditions, which may include identification, age requirements, prohibited items, and rules on behaviour, health and safety.
10.2 The Host may refuse you entry, or require you to leave, in line with the Event Terms and the law, for example for arriving after entry has closed, not having a valid Ticket or identification, not meeting an age requirement, or for behaviour that breaches the venue’s rules.
10.3 You must comply with the Host’s and the venue’s rules while at the Event. We are not responsible for the Host’s admission or conduct decisions.
10.4 The Host is responsible for the Event, including its delivery, its content, and the health and safety of those attending.
11.1 The Host is responsible for providing the Event, and for the Event being as described, of satisfactory quality, and safe.
11.2 If you have a problem with the Event, including its quality, delivery, safety, or your admission, you should raise it with the Host in the first instance. We can help put you in contact with the Host.
11.3 Locanter is not responsible for the Event or for the Host’s performance. Our role is limited to operating the platform and acting as the Host’s agent for the sale and collection of payment, as set out in clause 3 and in the Platform Terms.
12.1 Our liability to you in connection with the platform, your purchase and the Service Fee is governed by clause 16 of the Platform Terms, including the limits it contains and the matters for which we are not responsible. Nothing in these Ticket Purchase Terms increases, duplicates or replaces that.
12.2 In particular, and subject to clause 16.1 of the Platform Terms (which preserves your rights that cannot be excluded, and our liability for death or personal injury caused by our negligence and for fraud), we are not responsible for the Event, the acts or omissions of the Host, the contract of sale between you and the Host, the Ticket itself, or the cancellation, rescheduling or change of an Event, all of which are the responsibility of the Host.
13.1 We process your personal data in line with our Privacy Policy.
13.2 To fulfil your Order and your Ticket, we provide the Host with the booking information the Host needs, such as your name and order details. The Host uses that information to run the Event and to meet its obligations to you, and the Host is responsible for its own use of your personal data under its own privacy notice. For the Host’s own use of your data, the Host is a separate data controller.
14.1 If you have a complaint about your purchase, the platform or the Service Fee, please contact us at help@locanter.com. If your complaint is about the Event itself, please contact the Host, and we can help facilitate this.
14.2 If you are a consumer, you may also be able to refer a complaint to the Competition and Consumer Protection Commission in Ireland (www.ccpc.ie), or, where your dispute is with a trader based in another EU country, to the European Consumer Centre Ireland (www.eccireland.ie). Using these options does not affect your right to bring court proceedings.
15.1 We may change these Ticket Purchase Terms from time to time for a valid reason, such as reflecting changes to the platform or the checkout, changes in how we or Hosts operate, or to comply with the law.
15.2 The version of these Ticket Purchase Terms that applies to a purchase is the version in force at the time you place your Order. Changes do not affect Tickets you have already bought.
16.1 These Ticket Purchase Terms, and any dispute or claim arising out of or in connection with them or their subject matter, including non-contractual disputes or claims, are governed by the laws of Ireland.
16.2 The courts of Ireland have jurisdiction over any such dispute or claim. If you are a consumer resident in the European Union, you also benefit from any mandatory protections of the law of the country where you live, and nothing in these Ticket Purchase Terms affects your right as a consumer to bring proceedings, or to be sued, in the courts of the country where you live.
17.1 The general terms in clause 22 of the Platform Terms, including entire agreement, severability, no waiver, assignment, third-party rights, events outside our reasonable control, notices and language, apply to these Ticket Purchase Terms as if set out here, read so that references to the Platform Terms include these Ticket Purchase Terms.
17.2 These Ticket Purchase Terms, the Platform Terms and the Privacy Policy, together with the Host’s Event Terms and Refund Policy, are the entire agreement relating to your purchase of, and attendance at, an Event.
